笔者曾指出,宗教工作的法治化,是中央「依法行政」大方向在宗教领域的落实。诚然,「有法可依」比「无法无天」时代或「人治」进步,不过,这种进步,如果只在依法行政的技术层面取得保障,但却未能在核心价值上有所突破的话,「有法可依」只是「『依』法治国」,甚至是「『以』法治国」(rule by law)的表现,跟「法治」(rule of law)仍有很远的距离。[28]质言之,《草案》所体现的「法治化」,只是为党国管控及规范宗教,做到有「法」可依,以「法」行事,宗教界的合法权益是否能在法律上得到更充分的保障,仍是值得商榷的。
